1. Acceptance of Terms

By accessing or using LittleTunesAI ("the App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the App.

These terms govern all visitors, users, and anyone who accesses or uses the Service. By continuing to use the Service, you agree to any updates to these Terms.

You must be at least 18 years old or the age of majority in your jurisdiction to create an account. The App is designed for parents and caregivers to use with their children.

2. Description of Service

LittleTunesAI provides AI-generated personalized music for children's daily routines. Our service includes:

• Pre-generated songs for various routines (bedtime, playtime, mealtime, etc.)
• AI-personalized songs featuring your child's name or nickname (Premium)
• White noise and ambient sounds for relaxation
• Offline playback capabilities (Premium)

3. Subscriptions and Payments

Free Tier

The free tier provides limited access to pre-generated songs and basic player features. No payment information is required.

Premium Subscription

Premium subscriptions are billed on a recurring basis (monthly, quarterly, or annually). By subscribing, you authorize us to charge your payment method automatically.

• Prices are displayed in your local currency where available
• Subscriptions renew automatically unless canceled
• You can cancel anytime through the app or your app store

• Monthly: $7.99
• Quarterly: $19.99
• Annual: $49.99

Premium Features Include

• AI-personalized songs featuring your child's name or nickname, limited to 30 AI generated songs per month
• Unlimited songs in each category
• Offline playback
• Playback Timer
• All audio modes: With Lyrics, Instrumental
• Priority support via email

Payment Terms

• Subscriptions renew automatically unless cancelled before the renewal date
• Prices may change with 30 days' prior notice
• All payments are processed through Apple's App Store
• Subscription management is handled via RevenueCat

Refunds

Refunds are handled according to the policies of your app store (Apple App Store or Google Play Store). We do not process refunds directly. If you have billing issues, please contact the respective app store support.

4. Intellectual Property

All content in LittleTunesAI, including but not limited to songs, artwork, text, and software, is owned by LittleTunesAI or its licensors and is protected by copyright and other intellectual property laws.

Your License

We grant you a limited, non-exclusive, non-transferable license to use the App and its content for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of our services or content.

Personalized Songs

Songs generated with your child's name are for your personal use only. While you may share recordings with family and friends, commercial use or public distribution is prohibited.

5. Prohibited Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Create or distribute unlawful, harmful, or inappropriate content
• Attempt to reverse engineer, decompile, or hack the App
• Use bots, scripts, or other automated systems to access the App
• Share your account credentials with others
• Bypass or attempt to bypass usage limits or restrictions
• Use automated systems to access the App
• Redistribute, sell, or commercially exploit any content
• Disrupt, damage, or interfere with the security or performance of the App

6. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:

• The App will be uninterrupted or error-free
• The songs will achieve any particular outcome for your child
• All features will be available in all regions
• Accuracy of AI-generated content
• Compatibility with all devices or operating systems

LittleTunesAI is not a substitute for professional medical, psychological, or developmental advice. If you have concerns about your child's development or behavior, please consult a qualified professional.

7. Privacy & Data Protection

We take your privacy seriously. Our data collection and use practices are described in our Privacy Policy, which is incorporated into these Terms by reference.

• We comply with the Children's Online Privacy Protection Act (COPPA)
• We comply with the EU Children's Data Protection (GDPR-K)
• We adhere to the requirements of the General Data Protection Regulation (GDPR)
• All data is encrypted both in transit and at rest
• We do not sell personal information to third parties
• You have the right to access, update, and delete your personal data

8. Limitation of Liability

To the fullest extent permitted by applicable law, LittleTunesAI will not be responsible for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or business opportunities
• Damages arising from unauthorized access to or use of your account
• Interruptions, outages, or technical issues affecting the Service
• Content generated by third-party AI providers

In all cases, our total liability will not exceed the amount you paid for the Service during the twelve (12) months prior to the event giving rise to the claim.

9. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top of these Terms
• For material changes, we will notify you via email or in-app notification
• Continued use of the App after changes constitutes acceptance

10. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, if:

• You breach any provision of these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law

You may also terminate your account at any time by deleting your account through the app settings.

You can cancel your account at any time by:

• Using the account deletion option within the app
• Contacting our support team at support@littletunes.ai
• Cancelling your subscription through the App Store

Once your account is terminated, your right to use the Service ends immediately. However, some provisions of these Terms will continue to apply even after termination.

11. Governing Law and Dispute Resolution

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.

If you are a consumer residing in the European Union or another jurisdiction, you may also benefit from mandatory consumer protection rights under the laws of your country of residence. Nothing in these Terms is intended to limit or exclude such rights.

Dispute Resolution

We encourage parents or legal guardians to contact us first at support@littletunes.ai to resolve any questions or concerns regarding the App informally.

If a dispute cannot be resolved informally, it may be submitted to the competent courts of the Republic of Poland. If you are a consumer residing in the European Union, you may also bring a claim before the courts of your country of residence, in accordance with applicable consumer protection laws.

No Mandatory Arbitration

The App is intended for use by parents or legal guardians on behalf of their children. We do not require mandatory arbitration for disputes involving consumer rights, and nothing in these Terms limits the rights of parents or children under applicable law.
